Analytics & Data Terms

1. Intelligence Services

Dispense may provide dashboards, reports, comparisons, demand signals, consumer insights, competitive intelligence, search intelligence, geospatial intelligence, marketplace intelligence, predictions, recommendations and AI-generated outputs (“Intelligence Services”). Outputs are informational and may be estimated, probabilistic, incomplete or inaccurate.

2. Inputs and Rights

Business authorizes Dispense to use Integrated Data, Business Content, Platform activity, public information, licensed sources and third-party data to create and improve Intelligence Services, subject to the DPA. Dispense may use eligible nonpersonal, aggregated and deidentified data for model training, evaluation, retrieval, recommendations, search, forecasting and product development.

3. Ownership

Dispense exclusively owns the Intelligence Services and Derived Data, including methods, datasets, historical series, benchmarks, taxonomies, mappings, product graphs, features, embeddings, prompts, models, evaluations, rankings, scores, forecasts and outputs, except that Business retains its preexisting rights in Business Data and third parties retain their rights. No implied license or work-made-for-hire relationship arises.

4. Permitted Business Use

During an active subscription, Business may use delivered reports internally for its operations. Business may not resell, publish, benchmark Dispense publicly, reverse engineer, remove notices, share credentials, reconstruct another participant’s data, use outputs to train a competing product, or build or assist a competing marketplace, dataset, analytics or AI service without written permission.

5. No Decisions or Guarantees

Business is solely responsible for validating outputs and all business, pricing, inventory, employment, compliance, medical, legal and financial decisions. Dispense does not guarantee results, completeness, statistical significance, non-infringement of third-party data, or that an output will remain available or consistent over time.
