Ordering & Reservation Terms
1. Nonbinding Request Service
Dispense may let a consumer send a pickup, delivery-interest, preorder or reservation request (“Request”) to Business. A Request is a communication, not a sale, payment, acceptance, inventory hold, prescription or guarantee. Business is the sole retailer and seller. The consumer and Business form any transaction directly only after Business accepts as required by law.
2. No Online Cannabis Payment by Dispense
Dispense does not collect, hold, route or settle consumer payment for regulated products under this Addendum. Business collects payment directly and is solely responsible for payment methods, receipts, taxes, refunds, chargebacks, fraud and cash handling. Dispense may later offer separate payment functionality only under additional terms.
3. Business Responsibilities
- Monitor, timely respond to and accurately update Request status.
- Independently confirm product, quantity, price, discount, tax, availability and lawful purchase limits.
- Complete age, identity, medical eligibility and other required checks before transfer, regardless of information shown in a Request.
- Control substitutions, cancellations, pickup, delivery, returns, complaints and refunds.
- Provide legally required disclosures and receipts and maintain required records.
- Never treat Dispense’s transmission, account, geolocation or uploaded document as final regulatory verification.
4. Consumer Information
Business may use consumer information received with a Request only to respond, fulfill, support, prevent fraud, comply with law and as otherwise disclosed and lawfully authorized. Business may not sell it, add the consumer to unrelated marketing without required consent, or expose it to unauthorized personnel. The DPA applies when Dispense processes Personal Data for Business.
5. Errors and Support
Business bears the risk of inventory, price, promotion, tax, substitution and fulfillment discrepancies. Dispense may assist but has no obligation to resolve consumer disputes or provide refunds. Platform logs are prima facie evidence of transmission absent manifest error.
